1. Introduction

Wake AI ("we," "our," or "us") is committed to protecting your privacy. This Privacy Policy explains how we collect, use, disclose, and safeguard your information when you use our mobile application Wake AI ("the App"). Please read this privacy policy carefully.

2. Information We Collect

2.1 Personal Information

We collect the following personal information from you:

  • App Identifier: An app-generated analytics/support identifier may be stored in your device Keychain and used for service operations, support, analytics, subscription access, and free custom message credit enforcement
  • Alarm Data: Alarm times, recurrence settings, alarm status (enabled/disabled), labels, selected voice preferences, and generated alarm audio are primarily stored locally on your device
  • Custom Messages: Your personalized alarm messages (currently up to 300 characters) are used to generate AI spoken alarm audio
  • Generation and Entitlement Data: Custom message generation timestamps, credit usage, reserved/used/free credit counts, subscription entitlement state, and related service diagnostics
  • Usage Data: Alarm trigger timestamps, onboarding progress, feature interactions, paywall diagnostics, error logs, and app performance data

Important: Wake AI does not require traditional account creation. Alarm settings are primarily stored locally on your device. Custom messages may be sent to our servers and AI service providers when you request custom spoken alarm generation, and entitlement records may be stored server-side to provide free credits, subscriptions, reliability, support, and abuse prevention.

2.2 Automatically Collected Information

  • Device Information: Device model, iOS version, app version, build number, language/locale/region, and app identifiers
  • Analytics Data: App usage patterns, feature interactions, onboarding answers, attribution source, alarm creation flow, custom-message generation events, and error logs
  • Subscription Information: Subscription status, product identifiers, purchase diagnostics, trial start/end dates, renewal/cancellation/expiration events where available, and entitlement state

2.3 AI Ringtone Data

When you request a custom spoken alarm, your custom message and selected voice may be sent through our backend services and to our AI service provider (ElevenLabs) to generate personalized spoken alarm audio. These messages are processed to create audio files. Wake AI caches generated audio locally on your device to improve performance and reduce data usage. Cached audio is regenerated when you change the alarm message or voice. We also maintain server-side generation and credit records so free credits, subscription access, idempotency, abuse prevention, and support can work reliably.

3. How We Use Your Information

We use the information we collect to:

  • Provide and maintain the alarm and AI spoken-audio generation services
  • Generate personalized spoken alarm audio based on your custom messages
  • Provide free custom message credits and manage custom-message generation entitlements
  • Process subscription payments and manage subscription access
  • Send you important notifications about alarms and service updates
  • Analyze app usage to improve features and user experience
  • Detect and prevent fraud or abuse of our services
  • Comply with legal obligations and enforce our Terms of Use

4. Data Storage and Security

We implement industry-standard security measures to protect your data:

  • Cloud Storage: Entitlement, generation, support, analytics, and diagnostic data may be stored securely in Google Firebase and Firestore with encryption at rest
  • Local Storage: Alarm settings, preferences, cached generated audio, and app identifiers may be stored locally on your device using iOS storage technologies such as SwiftData, UserDefaults, and Keychain
  • Transmission Security: All data transmitted between the App and our servers uses TLS encryption
  • Access Controls: We implement strict access controls to limit who can access your personal data

However, no method of transmission over the internet or electronic storage is 100% secure. While we strive to protect your personal information, we cannot guarantee absolute security.

6. Data Sharing and Disclosure

We do not sell your personal information. We may share your information in the following circumstances:

  • Service Providers: With third-party vendors who perform services on our behalf (listed in Section 5)
  • Legal Requirements: When required by law, subpoena, or other legal process
  • Safety: To protect the rights, property, or safety of Wake AI, our users, or others
  • Business Transfers: In connection with a merger, acquisition, or sale of assets

7. Data Retention

We retain personal information for as long as needed to provide the App, maintain subscriptions and free-credit entitlement records, support users, prevent abuse, comply with legal obligations, resolve disputes, and enforce our agreements. Because Wake AI does not require traditional account creation, you may contact us to request deletion of eligible server-side personal data. Some local data can also be removed by deleting the App, subject to iOS behavior for Keychain and backup data. We may retain limited records where required for legal, security, fraud-prevention, accounting, or operational reasons.

8. Your Privacy Rights

Depending on your location, you may have the following rights:

  • Access: Request access to the personal information we hold about you
  • Correction: Request correction of inaccurate or incomplete data
  • Deletion: Request deletion of your personal information
  • Data Portability: Request a copy of your data in a structured, machine-readable format
  • Opt-Out: Opt out of certain data collection and processing activities

8.2 California Residents (CCPA)

If you are a California resident, you have additional rights under the California Consumer Privacy Act (CCPA):

  • Right to know what personal information is collected, used, shared, or sold
  • Right to delete personal information held by businesses
  • Right to opt-out of the sale of personal information (we do not sell personal information)
  • Right to non-discrimination for exercising CCPA rights

8.3 European Residents (GDPR)

If you are in the European Economic Area (EEA), you have rights under the General Data Protection Regulation (GDPR):

  • Right to access your personal data
  • Right to rectification of inaccurate data
  • Right to erasure ("right to be forgotten")
  • Right to restrict processing
  • Right to data portability
  • Right to object to processing
  • Right to withdraw consent at any time

9. Children's Privacy

Wake AI is not intended for children under the age of 13, and we do not knowingly collect personal information from children under 13. If we learn that we have collected personal information from a child under 13, we will take steps to delete such information as soon as possible. If you believe we have collected information from a child under 13, please contact us immediately.

10. International Data Transfers

Your information may be transferred to and processed in countries other than your country of residence. These countries may have different data protection laws. By using the App, you consent to the transfer of your information to the United States and other countries where we operate.

11. Do Not Track

Some browsers have a "Do Not Track" feature that lets you tell websites you do not want to have your online activities tracked. Our App does not currently respond to Do Not Track signals.

12. Changes to This Privacy Policy

We may update this Privacy Policy from time to time. We will notify you of any changes by posting the new Privacy Policy on this page and updating the "Last Updated" date. We encourage you to review this Privacy Policy periodically for any changes. Your continued use of the App after such modifications constitutes your acknowledgment and acceptance of the modified Privacy Policy.
